General Terms and Conditions
for the Provision of Services by FoundmyLove, Ritter-von-Weingarten Str. 17, 67366 Weingarten, Email: info@foundmylove.com (hereinafter “Contractor”) to its customers (hereinafter “Client”)

1. General Provisions
1.1 These General Terms and Conditions (GTC) for the provision of services apply to all contracts concluded between the Client and the Contractor incorporating these GTC.

1.2 If additional contractual documents or other terms have become part of the agreement in written or textual form alongside these GTC, the provisions of those documents shall prevail in the event of a conflict.

1.3 The Contractor does not recognize any deviating terms and conditions used by the Client unless explicitly agreed otherwise.

2. Subject Matter of the Contract and Scope of Services
2.1 The Contractor, acting as an independent service provider, offers the following services to the Client:

FoundmyLove is an international online dating platform that enables users to connect, build romantic relationships, or form friendships. The platform is targeted at an international audience, with men typically accessing paid features while women can use the platform for free.

The website offers a user-friendly and secure environment for matchmaking, including:

  • Creation and management of user profiles

  • Matching features based on interests, location, and profile data

  • Messaging features (text, images, potentially video)

  • Management of favorites and search filters

  • Algorithms to suggest potentially compatible matches

  • Premium subscriptions with enhanced features (e.g., unlimited messaging, profile boosters)

  • Moderation to enforce community guidelines

  • Technical measures to prevent fake profiles and spam

FoundmyLove positions itself as a trustworthy, modern platform for digital connection, aiming for respectful, authentic, and privacy-compliant user interaction.

2.2 The specific scope of services shall be determined in individual agreements between the Contractor and the Client.

2.3 The Contractor shall perform the agreed services with the utmost care, professionalism, and in line with current standards and best practices.

2.4 The Contractor is obligated to deliver the agreed services but is not subject to instructions regarding how, where, or when the services are rendered. The Contractor will independently schedule working days and hours to optimize efficiency and fulfill the contract purpose. Coordination with the Client will be maintained throughout the process.

3. Client Obligations
The Client must provide all necessary information, data, and content required for the Contractor to perform the services. The Contractor is not liable for delays resulting from the Client’s failure to cooperate in a timely and necessary manner. The provisions under “Liability/Indemnification” remain unaffected.

4. Compensation
4.1 Compensation will be agreed individually.

4.2 Payment is due after the services are rendered. If payment is time-based, it shall be due at the end of each respective period (Section 614 BGB). In case of effort-based billing, the Contractor is entitled to invoice monthly unless agreed otherwise.

4.3 The Contractor shall issue an invoice by mail or email (e.g., as a PDF). Payment is due within 14 days of receipt.

5. Liability / Indemnification
5.1 The Contractor shall be liable without limitation for intent or gross negligence, for injuries to life, body, or health, and where mandatory liability applies. For negligence of essential contractual duties, liability is limited to foreseeable, typical damages unless unlimited liability applies. Essential duties are those that enable proper contract execution and on which the Client routinely relies. Further liability is excluded. This also applies to agents and legal representatives.

5.2 The Client shall indemnify the Contractor from all third-party claims arising from violations of these terms or applicable laws by the Client.

6. Contract Duration and Termination
6.1 Contract duration and termination notice periods shall be individually agreed.

6.2 The right to immediate termination for cause remains unaffected.

6.3 Upon termination, the Contractor shall return or destroy all materials received, as requested by the Client. Retention rights are excluded. Electronic data must be deleted, except where legal retention requirements apply, in which case data must be stored only until the retention period ends. Deletion must be confirmed in writing upon request.

7. Confidentiality and Data Protection
7.1 The Contractor shall treat all information received in connection with the contract as strictly confidential. This obligation extends to all employees and third parties involved. Confidentiality remains in effect indefinitely beyond the contract term.

7.2 The Contractor agrees to comply with all applicable data protection laws, especially the GDPR and the Federal Data Protection Act.

8. Final Provisions
8.1 German law applies, excluding the CISG.

8.2 If any provision is or becomes invalid, the remainder of these GTC remains unaffected.

8.3 The Client shall support the Contractor through reasonable cooperation, especially by providing necessary information and data.

8.4 If the Client is a merchant, legal entity under public law, or does not have a general jurisdiction in Germany, the place of jurisdiction shall be the Contractor’s location. Exclusive jurisdictions remain unaffected.

8.5 The Contractor may amend these GTC for objectively justified reasons (e.g., legal or strategic changes) with appropriate notice. Existing Clients will be notified via email at least two weeks prior to the effective date. If no objection is made within the set period, the change is deemed accepted. If objected to, changes do not take effect, and the Contractor may terminate the contract exceptionally. The notice will outline the objection period and consequences.

9. Online Dispute Resolution / Consumer Arbitration
The EU Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr

This platform serves as a contact point for resolving disputes related to online purchases or service contracts involving consumers. The provider is neither willing nor obligated to participate in a consumer arbitration procedure under the VSBG.
