Terms for Businesses and Partners

Last updated: October 2026 · applies to advertisers, venues with a business account and affiliate partners

These terms govern business cooperation with FoundmyLove. The private use of the dating platform by members is governed exclusively by our General Terms and Conditions. How we process personal data is explained in our Privacy Policy. The German version of these terms is legally binding; this English version is provided for information.

Part A – General provisions

§ A1 Scope

  1. These terms apply to all contracts between FoundmyLove and
    (a) advertisers booking advertising space (banners) on foundmylove.com (Part B),
    (b) venues and organisers (e.g. restaurants, bars, cafés, event providers) offering events in the “Community meetups” section via a business account (Part C), and
    (c) affiliate partners recommending FoundmyLove in return for commission (Part D)
    (together “partners”).
  2. Advertisers and venues must be businesses (entrepreneurs within the meaning of Section 14 of the German Civil Code, BGB), public-law entities or comparable organisations. Affiliate partners act independently and on their own account when taking part in the partner program. Where a partner is a consumer in an individual case, mandatory consumer protection law remains unaffected.
  3. The partner’s own terms and conditions do not apply, even if we do not expressly object to them. Individual agreements in text form (e.g. offer, booking confirmation, email) take precedence.
  4. Part A applies to all partners. Parts B, C and D additionally apply to the respective area and prevail over Part A in case of conflict.

§ A2 Contracting party

  1. Your contracting party is: Sven Wolf, Datingportal – FoundmyLove.com, Bergstr. 5, 67808 Weitersweiler, Germany, email: support@foundmylove.com, VAT ID: to follow (“FoundmyLove” or “we”).
  2. FoundmyLove is currently in a beta phase. Features, ad spaces and processes may change, be extended or discontinued.

§ A3 Conclusion of contract

  1. Information on our website (e.g. on the pages “Advertise on FoundmyLove”, “Community meetups” and “Affiliate program”) does not constitute a binding offer.
  2. Advertising requests, registering a business account, submitting an event and applying to the partner program are offers by the partner. A contract is only concluded when we confirm the offer in text form, activate the business account or event, or accept the partner application.
  3. There is no entitlement to a contract, activation or a particular placement. We may decline requests without giving reasons.
  4. The partner warrants that its details (in particular company name, address, contact person, tax number and payout details) are complete and correct and will inform us of changes without undue delay.

§ A4 Partner obligations, content and third-party rights

  1. The partner is responsible for all content it provides to us or uses to refer to FoundmyLove (e.g. banners, texts, images, landing pages, event descriptions, social media posts). It ensures that such content and its advertising comply with applicable law, in particular competition, trademark, copyright, personality, youth protection, consumer protection and data protection law as well as rules on labelling advertising.
  2. The partner warrants that it holds all necessary rights to the content provided (e.g. image, trademark and usage rights and the consent of any persons depicted). For the term of the contract it grants us the simple, worldwide right to store, reproduce, technically adapt (e.g. format, cropping, compression) and make this content publicly available on foundmylove.com in all language versions for the purpose of the contract.
  3. In particular, content or offers are not permitted that
    – are pornographic, sexually offensive or aimed at paid sexual contacts,
    – depict or promote violence, hatred, discrimination or extremism,
    – advertise gambling without the required licence, weapons, drugs, prescription medicines or tobacco,
    – are misleading (e.g. false promises of winnings, healing or earnings, pyramid schemes, dubious financial or crypto offers),
    – contain malware, phishing or hidden redirects,
    – advertise other dating, matchmaking or escort services,
    – target minors or endanger their interests.
  4. The partner indemnifies FoundmyLove against all third-party claims based on a culpable breach of these obligations, including reasonable legal defence costs. FoundmyLove will inform the partner of such claims without undue delay and give it the opportunity to comment.

§ A5 Review, rejection and suspension

  1. We review ad materials, events, business accounts and partner applications before activation. Such review does not mean that we assume responsibility for the lawfulness of the content.
  2. We may reject, request changes to, temporarily hide or remove content and pause or block business accounts and partner access if there are concrete indications of a breach of these terms, of the law or of our members’ interests, or if an authority, court or entitled third party requests this. We take the partner’s legitimate interests into account and inform it of the reason where legally permissible.

§ A6 Prices, invoices and payment

  1. The prices stated in the offer, booking confirmation or on the website apply. All prices are net prices plus statutory VAT where applicable.
  2. For partners established in another EU member state who provide a valid VAT identification number, the reverse-charge procedure may apply. For partners outside the EU, taxation follows the applicable rules. The partner must provide us with the information required for this correctly.
  3. Invoices are provided electronically by email or in the partner’s account. Unless agreed otherwise, invoices are payable without deduction within 14 days of the invoice date. Advertising bookings must be paid before the start of the term unless agreed otherwise.
  4. If the partner is in default, the statutory provisions apply (Sections 286, 288 BGB). We may withhold services until outstanding amounts are settled, hide ad materials and refrain from publishing events.
  5. The partner may only set off undisputed or legally established claims against our claims.

§ A7 No guarantee of success, availability

  1. We do not owe any particular economic success, in particular no specific number of impressions, clicks, sign-ups, participants, registrations or revenue, unless expressly guaranteed in writing.
  2. We strive for high availability of the website. Maintenance, technical faults, outages at service providers and force majeure may cause interruptions. To the extent permitted by law, we give no warranty for outages during the beta phase.

§ A8 Liability

  1. We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and to the extent of any guarantee given.
  2. In the event of a slightly negligent breach of material contractual obligations (obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance the partner may regularly rely), our liability is limited to the foreseeable damage typical for the contract, but no more than the fees paid by the partner to us in the twelve months before the damaging event or – for affiliate partners – the commissions paid out in that period.
  3. Otherwise, liability for slight negligence is excluded. This applies in particular to lost profit, lost savings and indirect damage.
  4. The above limitations also apply in favour of our vicarious agents.

§ A9 Confidentiality and data protection

  1. Both parties treat confidential information of the other party (e.g. terms, statistics, internal processes) confidentially and use it only for the purpose of the contract.
  2. As a rule, partners do not receive any personal data of our members from us. We provide statistics only in aggregated form and without names or contact details. Where a partner receives personal data in an individual case (e.g. messages from guests to a venue), it may use such data exclusively for the respective purpose, in particular not for its own advertising, and must comply with the General Data Protection Regulation (GDPR).
  3. Details on how we process the data of partners and visitors can be found in our Privacy Policy.

§ A10 Term and termination

  1. The term is governed by Parts B to D or the individual agreement.
  2. The right of both parties to terminate for good cause remains unaffected. Good cause exists for us in particular if the partner, despite a warning, repeatedly or once seriously breaches these terms, provides false information, harasses or endangers members, manipulates (e.g. click or registration fraud) or is more than 30 days in arrears with payments.
  3. Notices of termination must be given in text form (e.g. by email to support@foundmylove.com).

§ A11 Changes to these terms

  1. We may amend these terms for the future where this is necessary for legal, technical or business reasons (e.g. new laws, new features, changed ad spaces).
  2. We will inform current partners in text form at least six weeks before the changes take effect. If the partner does not object before they take effect, the changes are deemed accepted; we will point this out separately in the notice. In the event of an objection, either party may terminate the contract with effect from the date the change takes effect. Services already paid for and commissions already earned remain unaffected.

§ A12 Final provisions

  1. The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
  2. If the partner is a merchant, a legal entity under public law or a special fund under public law, or has no general place of jurisdiction in Germany, the exclusive place of jurisdiction for all disputes arising from this contract is the registered seat of FoundmyLove. We may also sue the partner at its general place of jurisdiction.
  3. The contract language is German. Translations are for information only; in case of conflict the German version prevails.
  4. Should any provision be invalid, the remainder of the contract remains effective. The invalid provision is replaced by the statutory provision.

Part B – Advertising (banners)

§ B1 Scope of services

  1. We display the advertiser’s ad materials in the booked ad spaces, currently
    – Space 1: above the member search,
    – Space 2: below the member list.
  2. Delivery may be restricted by page language and by the visitor’s country. We determine the country from the profile for logged-in members and otherwise from the IP address (without storing it). Several ad materials in one space rotate automatically; only one ad material is visible in a space at any time.
  3. Ad materials are clearly labelled as “Ad” (or the equivalent in the page language). Links on ad materials are marked as paid links (rel="sponsored").
  4. Members with a Gold or Platinum membership do not see advertising. The reach of a booking therefore relates only to visitors and free members.
  5. We only owe a specific position in the rotation, a specific number of impressions or clicks or competitor exclusivity if expressly agreed in text form.

§ B2 Ad materials

  1. The advertiser delivers the ad materials no later than five working days before the start of the term, with separate banners per language if desired. Recommended format: 1,200 × 300 pixels (aspect ratio 4:1), JPG, PNG, WebP or animated GIF, max. 5 MB per file. We may crop or scale different formats.
  2. The advertiser names the target page (link). It is solely responsible for the content, availability and lawfulness of the target page, including legal notice, privacy information and any cookie banner. Affiliate links are permitted.
  3. If ad materials are delivered late, incomplete or not in accordance with the contract, the term is not automatically extended; the agreed price remains payable.

§ B3 Term and booking

  1. The term results from the booking confirmation. The booking ends automatically at the end of the term; there is no tacit renewal.
  2. Ordinary termination during a fixed booking term is excluded. If the advertiser cancels before the start of the term, we may claim reasonable compensation of no more than 50 % of the agreed price; the advertiser may prove that the damage was lower.

§ B4 Outages and statistics

  1. If an ad material cannot be displayed for more than three consecutive days for reasons for which we are responsible, we will extend the term accordingly or credit the pro-rata price. Further claims are governed by § A8.
  2. We count clicks on ad materials with our own technical means. Obviously automated or manipulated clicks are disregarded. Our statistics are authoritative unless the advertiser proves errors.

Part C – Venue events (Community meetups)

§ C1 Business account

  1. Restaurants, bars, cafés and other commercial organisers (“venue”) can offer their own events in the section “Events by restaurants & bars”. This requires a business account that is kept separate from dating profiles.
  2. When registering, the venue provides complete and truthful information, in particular company name, legal form, address of the venue, authorised representative or contact person, email address and – where available – tax number or VAT identification number. We may request evidence (e.g. business registration, commercial register extract).
  3. A business account is not a member account: it has no access to member profiles, the member search or the normal member menu and receives no welcome credits. It serves exclusively to create and manage the venue’s own events, retrieve invoices and answer guest questions via the event chat.
  4. Login details must be kept secret. The venue is liable for actions carried out via its business account to the extent it is responsible for them.

§ C2 Events and publication

  1. The venue creates events with title, description, date, time, location, number of places and, where applicable, images. Events take place exclusively at publicly accessible places or on the venue’s business premises, never in private homes.
  2. We review every event before publication and may reject it or request changes. There is no entitlement to publication or a particular placement.
  3. Event information must be accurate. Costs borne by guests on site (e.g. food and drink, set menu price, minimum spend) must be stated clearly and completely in the description. Any further entrance fees or charges to guests are only permitted if agreed with us in advance and clearly stated in the event.

§ C3 Participation of members

  1. FoundmyLove members aged 18 or over may take part. Gold and Platinum members take part without a registration fee. Free members pay FoundmyLove a registration fee (currently €9.99, payable in credits). This fee belongs exclusively to FoundmyLove.
  2. Guests pay for food, drink and other services on site directly to the venue. Contracts for these services are concluded exclusively between the guest and the venue.

§ C4 Remuneration

  1. For each published event, the venue pays FoundmyLove the fixed price per event stated in the offer or price list for venues, plus statutory VAT where applicable.
  2. Invoicing takes place after the event has been published. § A6 applies accordingly.
  3. If the venue cancels a published event less than 48 hours before it starts, or if it does not take place for reasons for which the venue is responsible, the price remains payable. If the event is cancelled at least 48 hours in advance, no price is payable unless agreed otherwise.

§ C5 Venue obligations

  1. The venue holds the event as announced and is solely responsible for what happens on site. It complies with all regulations applicable to the event, in particular licensing and alcohol law, youth protection (age checks, serving alcohol), hygiene, fire safety, noise protection, accessibility information and house rules.
  2. The venue ensures a safe and respectful environment, intervenes in case of harassment and reports incidents to us via the report function or by email.
  3. The venue holds the business liability insurance customary for its business.
  4. If an event has to be cancelled or changed, the venue informs the guests without undue delay via the platform and us by email. We refund registration fees already paid to participants in credits.
  5. The venue may not photograph or film guests or publish photos or recordings without their express consent. It may use guest data (e.g. from the event chat) only for the respective event and not for advertising, newsletters or disclosure to third parties.

§ C6 Reviews and role of FoundmyLove

  1. Participants can rate and report events. We may display reviews unless they are unlawful. The venue can object to unlawful reviews via the report function.
  2. FoundmyLove merely provides the platform for announcing events and registering for them and is not the organiser of venue events. For damage arising on site in connection with an event, we are only liable in accordance with § A8. The venue indemnifies us against third-party claims based on the holding of the event to the extent it is responsible for them.

§ C7 Term

  1. The contract for the business account runs for an indefinite period and may be terminated by either party at any time with 14 days’ notice in text form. Events already published are completed unless cancelled.
  2. After the end of the contract we delete the business account unless statutory retention obligations (in particular for invoices) prevent this.

Part D – Affiliate partner program

§ D1 Participation

  1. Adult natural persons and businesses operating their own website, social media channel or comparable medium can take part in the partner program. Participation requires an application via the “Affiliate program” page and our acceptance.
  2. The partner acts as an independent entrepreneur. Participation does not create an employment, commercial agency, partnership or other representation relationship. The partner may not act in the name of FoundmyLove or make declarations on our behalf.
  3. The partner is itself responsible for determining whether it must register a business or fulfil other registration or tax obligations for its activity.

§ D2 Partner link and attribution

  1. After acceptance, the partner receives a personal partner code, a partner link (any page of foundmylove.com with the addition “?partner=CODE”) and personal access to its partner dashboard. The partner keeps the dashboard link secret.
  2. If a visitor accesses the website via the partner link, the visitor is attributed to the partner for 30 days (cookie duration). If the visitor registers as a new member within this period, the member is permanently attributed to this partner. Where several partner links are used, the last link clicked before registration counts.
  3. No attribution takes place if the visitor is already a member, if the partner or a person controlled by it registers, if cookies are blocked or deleted or if the registration cannot otherwise be technically attributed. There is no entitlement to commission for registrations that were not technically recorded.

§ D3 Commission

  1. The partner receives a commission on the net amount (excluding VAT) of every paid purchase of premium packages (Gold/Platinum) and credits made by a member attributed to the partner within 12 months of that member’s registration. The rate depends on the partner level: Starter 30 % (0–24 paying new customers), Bronze 35 % (25–49), Silver 40 % (50–99), Diamond 45 % (100 or more). A special rate agreed in text form in an individual case takes precedence.
  2. “Paying new customers” are members attributed to the partner whose first commissionable, non-cancelled purchase falls within the last 90 days (rolling). The level is recalculated automatically; the level at the time of the respective purchase applies. A change of level only affects future purchases – commissions already earned are neither increased nor reduced. We may change levels and rates with effect for the future; we will announce any reduction at least 30 days in advance in text form.
  3. If we offer a two-tier partner programme, a partner who has recruited a new partner receives a partner bonus equal to the stated percentage of the commission actually earned by the recruited partner (one level only). Nothing is paid for the mere sign-up of a partner; self-referrals and sham sign-ups are excluded. If the recruited partner’s commission lapses, the partner bonus lapses as well.
  4. We convert amounts in other currencies into euros at the reference rate of the European Central Bank at the time of purchase.
  5. No commission arises for free services, welcome and bonus credits, memberships granted manually by us or won in the game room, purchases after the 12 months have expired, purchases by members not attributed via the partner link, or registration fees for Community meetups.
  6. If a purchase is withdrawn, refunded, cancelled or reversed by chargeback, the commission lapses. If it has already been paid out, we set it off against future commissions; if a set-off is not possible, it must be repaid.

§ D4 Release and payout

  1. Commissions are initially “pending” and become “available” 30 days after the purchase, provided the purchase has not been withdrawn, refunded or cancelled.
  2. We pay out available commissions monthly once the balance amounts to at least €50. Lower balances are carried forward to the following month.
  3. Payout is made, at the partner’s choice, via PayPal, SEPA transfer or international bank transfer (SWIFT) to the details stored in the partner dashboard. The partner is responsible for the accuracy of these details. Fees of the receiving payment service and currency conversion costs are borne by the partner.
  4. After the end of the contract, we pay out available balances even below €50 within 60 days, provided there are no claims under § D6. Payout claims become time-barred in accordance with the statutory provisions.
  5. The commission statement can be viewed in the partner dashboard at any time. Objections to a statement must be raised in text form within three months of payout.

§ D5 Taxes

  1. Commissions are net amounts. The partner is itself responsible for paying tax on its income.
  2. If the partner provides a tax number or VAT identification number and owes VAT for its service, we will – where legally possible – settle by self-billing (credit note, Section 14(2) sentence 2 of the German VAT Act) and pay the statutory VAT in addition, unless the tax liability is transferred to us under the reverse-charge procedure. Partners who do not charge VAT as small businesses must inform us of this.
  3. We may request further information or evidence from the partner where this is necessary for tax treatment or statutory reporting obligations (e.g. tax residence, tax number). We may withhold payouts until such information is provided.

§ D6 Promotion rules for partners

  1. The partner promotes FoundmyLove truthfully, reputably and in compliance with all laws and the rules of the platform used (e.g. Instagram, TikTok, YouTube, Facebook). It labels its recommendation as advertising where required (e.g. “Advertisement”, “Ad”, “#ad”).
  2. In particular, the following are not permitted:
    – spam (unsolicited emails, messages, comments or mass postings),
    – fake, test or self-registrations and registrations in return for rewards, discounts or other consideration (incentivisation), unless agreed with us,
    – search engine advertising on the brand “FoundmyLove” or similar terms (brand bidding) and domains, profiles or accounts that can be confused with FoundmyLove,
    – cookie dropping, click manipulation, automated calls, hidden redirects, pop-ups or embedding in frames,
    – advertising on sites with pornographic, violence-glorifying, discriminatory, unlawful content or content aimed at minors,
    – misleading statements, e.g. about guaranteed success, free premium services, the number or origin of members, prices or features,
    – approaching or poaching members within the platform.
  3. In the event of a breach, we may cancel or reclaim the commissions concerned, pause the partnership and terminate it without notice for good cause. Further claims remain reserved.

§ D7 Use of brand and ad materials

  1. For the duration of the partnership we grant the partner the simple, non-transferable right, revocable at any time, to use the name “FoundmyLove” and the ad materials provided by us exclusively to promote FoundmyLove via the partner link.
  2. Logos and ad materials may not be altered except for technical resizing. When the partnership ends, partner links and ad materials must be removed within 14 days.

§ D8 Term, pause and end

  1. The partnership runs for an indefinite period and may be terminated by either party at any time with 14 days’ notice to the end of a month in text form.
  2. We may temporarily pause the partnership, e.g. if we suspect breaches or need to verify information. During a pause, no new clicks, registrations or commissions are recorded via the partner link; the dashboard remains accessible.
  3. No new commissions arise after the end of the contract. § D4 applies to purchases made before the end of the contract.
  4. Changes to the conditions (e.g. commission rate, term, cookie duration, minimum payout) apply only for the future and in accordance with § A11.
