Terms of Participation – “Invite Friends” Referral Program

1. Organiser and scope

The referral program “Invite Friends” (the “Program”) is organised by FoundmyLove, Sven Wolf, Bergstr. 5, 67808 Weitersweiler, Germany (“FoundmyLove”, “we”, “us”). Contact: support@foundmylove.com.

Our Terms and Conditions and our Privacy Policy also apply. By sharing their personal invitation link or invitation code, the referring member accepts these Terms of Participation.

2. Eligibility

• Registered FoundmyLove members who are at least 18 years old and whose member account is active and not blocked may participate (the “Referrer”).
• Each person may only hold one member account and may only participate with that account.
• Participation is free of charge and voluntary. There is no entitlement to participate.

3. How it works

1. Every Referrer receives a personal invitation link and an invitation code in the “Invite friends” section (avatar menu or profile settings).
2. The Referrer shares the link or code personally with people they know, e.g. in person, via messenger or on social networks.
3. The invited person (the “Referee”) signs up via the invitation link or enters the code in the “Invitation code” field during registration.
4. If the Referee meets the requirements of section 4, the Referrer receives the reward set out in section 5.

FoundmyLove does not send invitations to people the Referrer wishes to invite.

4. Valid referral

A referral is valid if all of the following requirements are met:

• The Referee was not previously registered with FoundmyLove and signs up via the Referrer’s invitation link or with the Referrer’s invitation code. A subsequent assignment is only possible in justified exceptional cases via our support team.
• The Referee is a real person, not identical with the Referrer and at least 18 years old.
• The Referee has confirmed their email address via the confirmation link.
• The Referee has uploaded a genuine profile photo of themselves, which has been approved.
• The registration has been reviewed and approved by FoundmyLove. We check in particular for duplicate, fake and sham accounts. Approval is at our reasonable discretion.
• The Referee’s account is not blocked at the time of the review.

Each Referee can only be assigned once and to one Referrer. The Referee does not receive a reward from the Program.

5. Rewards

The Referrer receives a reward for each valid referral. The reward depends on the number of valid referrals within a round of ten referrals:

After the tenth valid referral, a new round with the same levels begins.

• Bonus credits are added to the Referrer’s credit account and can be used like other bonus credits on FoundmyLove. They have no cash value, are not paid out or refunded and are not transferable.
• Gold and Platinum memberships from the Program are free of charge, do not renew automatically and end without cancellation.
• If a membership of the same level is already active when the reward is credited, it is extended by the duration of the reward. If a higher-level membership is active (Platinum in the case of a Gold reward), the reward starts when it ends. A Platinum reward applies from the time it is credited; an active Gold membership is extended by the duration of the Platinum reward so that no Gold days are lost.
• Rewards cannot be paid out in cash, exchanged for other services or transferred to other accounts.

6. Crediting and progress

The reward is credited automatically as soon as the referral is valid under section 4, usually within a few days of approval. The Referrer is notified by email and on their next visit to the website. In the “Invite friends” section, the Referrer can see at any time how often their link has been opened, how many people have signed up, which requirements are still missing for each Referee and which reward comes next.

7. Rules for sharing

The Referrer may only share their link or code in a fair and lawful manner. In particular, the following is not permitted:

• sending unsolicited messages (spam), mass emails or messages to people who have not agreed to receive them;
• publishing the link or code on voucher, bonus, cashback or reward portals;
• paid advertising, e.g. search engine or social media ads, in particular using the “FoundmyLove” brand or confusingly similar terms;
• misleading statements about FoundmyLove, e.g. false promises regarding costs or chances of success, or giving the impression of acting on behalf of FoundmyLove;
• creating one’s own secondary or fake accounts, registering other people without their knowledge, and any form of technical manipulation.

The Referrer is responsible for complying with applicable law when sharing their link, in particular data protection and advertising regulations.

8. Abuse, exclusion and withdrawal of rewards

In the event of violations of these Terms of Participation or a justified suspicion of abuse, we may

• treat individual referrals as invalid,
• withdraw rewards already credited, i.e. deduct bonus credits or remove Gold or Platinum days,
• exclude the Referrer from the Program and
• in the event of serious violations, block the member account in accordance with our Terms and Conditions.

A reward may also be withdrawn if the Referee’s account is blocked within 30 days of the reward being credited due to a violation of our Terms and Conditions, or if it turns out that the requirements of section 4 were not met. If bonus credits have already been used, only the remaining balance is deducted.

9. Changes and termination of the Program

We may change, suspend or terminate the Program, the rewards and these Terms of Participation at any time with effect for the future, in particular in the event of abuse, technical problems or for economic reasons. Rewards for referrals that became valid before the change or termination remain unaffected. We will publish changes on this page.

10. Data protection

To run the Program, we process: the link between Referrer and Referee, the time of registration, the status of the referral (email confirmed, profile photo available, approval), the rewards granted, a history of these events and an encrypted check value (hash) of the IP address that we use to detect duplicate accounts; the IP address itself is not stored for this purpose. We also count how often an invitation link has been opened without identifying the people opening it.

The legal bases are Art. 6(1)(b) GDPR (running the Program) and Art. 6(1)(f) GDPR (our legitimate interest in preventing abuse).

The Referrer only sees the username and the referral status of their Referees, not their email addresses or other profile data. When a visitor opens an invitation link, the invitation code is stored temporarily in the browser only for the duration of the browser session so that it can be entered automatically during registration. We store the data for as long as the respective member account exists. Further information can be found in our Privacy Policy.

11. Liability

FoundmyLove’s liability is governed by our Terms and Conditions. There is only an entitlement to a reward if the requirements of these Terms of Participation are met. If a Referee was not assigned for technical reasons, e.g. because the invitation code was not applied during registration, the Referrer can contact our support team.

12. Final provisions

The law of the Federal Republic of Germany applies. Mandatory consumer protection provisions of the country in which the Referrer has their habitual residence remain unaffected. Should individual provisions of these Terms of Participation be invalid, the validity of the remaining provisions shall remain unaffected.
